The Hailey City Council is set to hold a public hearing Monday on a proposed ordinance that would make reckless e-bike operation a misdemeanor offense.

The ordinance defines reckless use as “use on a sidewalk, street, pathway, roadway, highway or any public or private property open to public use, carelessly and heedlessly, or without due caution and circumspection, or at such a speed or in any other manner as to endanger or be likely to endanger any person or property.”

A misdemeanor is punishable by up to six months in jail and a fine of up to $1,000. A previous draft of this ordinance was heard and discussed by the City Council in November, the Express previously reported.

A misdemeanor charge would also be triggered if an individual has already been found guilty of two or more infractions for violating other laws established by the ordinance. 

The proposed ordinance creates a 20-mile-per-hour speed limit on multi-use pathways and requires riders under the age of 18 to wear a helmet.

The city has recommended that council members on Monday hold the first of three public readings of the ordinance required to adopt it into law, though they are not required to hold the reading.

Monday’s meeting is set to begin at 5:30 p.m. in Hailey City Hall.
