
Tesla's recently announced limited editions of the Model S and Model X will be subject to a one-year resale ban. As reported by Electrek, citing a person who was offered one of the vehicles for purchase, unauthorized resale will carry a penalty of at least $50,000 — the same rule that applied to the Cybertruck.
Buyers of the Model S and Model X Signature Editions, which are priced at just under $160,000 each, must commit to not reselling the vehicle during the first year of ownership. Should a sale become necessary due to unforeseen circumstances, Tesla must be notified so the company can buy the car back.
The buyback price is calculated as the original purchase price minus $0.25 per mile driven, with further deductions for wear and tear. If Tesla declines to buy the car back, owners may resell it with written approval from Tesla.
Penalty and Ban for Unauthorized Resale
Without that approval, Tesla can impose a contractual penalty of $50,000 or the resale price — whichever is higher. Given that only 250 Model S Signature Editions and 100 Model X Signature Editions are being produced, the fine will likely exceed $50,000 in most cases, as the vehicles' value is expected to appreciate. The rule is designed to prevent "flipping" — buying solely to resell at a profit.
Tesla also reserves the right to ban violating buyers from purchasing any future Tesla vehicles. Since the Signature Editions are sold by invitation only — presumably to loyal Tesla fans — that ban could sting more than the financial penalty, whose legal enforceability remains questionable.
Tesla introduced a similar rule with the Cybertruck launch in late 2023, when the electric truck was being resold for as much as $300,000. After some backlash, Tesla dropped the rule in the summer of 2024, and it's unknown whether the fine was ever actually enforced in court — doing so would almost certainly generate negative press.
Resale restriction clauses are fairly common in the luxury goods world. Rolex, for instance, closely monitors whether newly purchased watches are immediately flipped. Given the limited production numbers of the Signature Editions, a resale penalty makes sense from a market perspective.
