JAMES CITY COUNTY— As electric‑powered bikes and similar vehicles become more popular, the James City County Police Department is reminding residents that not all electric bikes are the same, and some are illegal to operate on Virginia roads, sidewalks and trails.

The department says that many riders unknowingly purchase electric dirt bikes believing they are e‑bikes, but the two are treated very differently under Virginia law.

Under Virginia Code § 46.2‑904.1, legal e‑bikes (Class 1, 2 and 3) are treated the same as bicycles when they meet specific requirements. A legal e‑bike must have operable pedals, a motor of 750 watts or less and must fall within Virginia’s three‑class e‑bike system. These bikes do not require a license, registration or insurance and may be used on roads, sidewalks and bike paths unless otherwise posted.

In contrast, police say that many popular electric dirt bikes do not meet the definition of an e‑bike. These vehicles typically lack pedals, can reach speeds over 35 mph and are classified as off‑road motorcycles or motor vehicles. They are not street legal and may not be operated on public roads, sidewalks or most trails. If operated illegally, they may be impounded, and riders may face charges including operating an off‑road motorcycle on public roads, registration or licensing violations, reckless driving or operating without a license or insurance.

Helmet requirements also vary. All riders of Class 3 e‑bikes must wear a helmet, and riders 14 and under must wear a helmet on any e‑bike under James City County ordinance. Helmets are strongly recommended for all riders. Operators of electric dirt bikes or moped‑type vehicles must wear a DOT, Snell or ANSI‑approved helmet.

“To stay within the law, the key things to look for are pedals, motor size and whether the bike fits into the Class 1, 2 or 3 system,” said Sgt. Jon Evans, Traffic Unit supervisor. “If it looks like a dirt bike and has no pedals, it is almost certainly not legal on public roads or trails.”

Residents are encouraged by the JCC police to review Virginia Code § 46.2‑904.1 and verify the classification of any electric bike before riding.
